Personal data is generally classified as any information or opinion, whether true or not that is recorded in a material form or not, that could directly or indirectly identify you.
Customers may only use Pineatix Services for lawful purposes. Transmission of any material in violation of any Country, Federal, State or Local regulation is prohibited. To this effect, any pornography is prohibited as well as housing any copyright information (to which the customer does not hold the copyright or any appropriate licenses) on Pineatix servers through any Services.
Websites dedicated to the discussion of hacking activities or the distribution of hacking tools are prohibited. Also, the usage of Pineatix’s systems or network to access any system, service, or network without the owner's consent is expressly forbidden.
Anonymous proxies are easily abused and often cause a negative impact on both the servers and the network they are connected to. As such, they're prohibited on Pineatix’s network and servers.
Usage of the Pineatix network to impersonate another person or entity, be it through Email, Internet Forums, or any other means, is strictly prohibited. This includes spoofing email or network packet headers whether or not it is done for malicious purposes.
Remember, you have a right to use a pseudonym when using our services, this is not allowed however when processing payments to prevent against fraud. So long as you are not impersonating or attempting to impersonate another person and are only concealing your own information with fake information (a pseudonymity) there is no violation of this policy or the Terms of Service Agreement.
Customer agrees to not engage in activities pertaining to Black Hat SEO, Spamdexing, and so-called “Scraper sites.” These can all have a severely detrimental effect on server performance and are not permitted.
Any conduct that is likely to result in retaliation against Pineatix's network or website, or Pineatix's employees, officers or other agents, including engaging in behavior that results in any server being the target of a denial of service attack (DoS).
You may not publish or transmit via Pineatix’s services any content that Pineatix reasonably believes constitutes inappropriate or offensive content at the absolute sole discretion of Pineatix. This includes but is not limited to;
i. Constitutes child pornography;
ii. Constitutes pornography;
iii. Is excessively violent, incites violence, threatens violence, or contains harassing content or hate speech;
iv. Is unfair or deceptive under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes;
v. Is defamatory or violates a person’s privacy;
vi. Creates a risk to a person’s safety or health, creates a risk to public safety or health, compromises national security or international security, or interferes with an investigation of law enforcement;
vii. Improperly exposes trade secrets or other confidential or proprietary rights;
viii. Is intended to assist others in defeating technical copyright protections;
ix. Clearly infringes on another person’s trade or service mark, patent, or other property right;
x. Promotes illegal drugs, violates export control laws, relates to illegal gambling or illegal arms trafficking;
xi. Is otherwise illegal or solicits conduct that is illegal under laws applicable to you or to Pineatix; and/or
xii. Is otherwise malicious, fraudulent, or may result in retaliation against Pineatix by offended viewers.
You have a right to use a pseudonym when using our services, this is not allowed however when processing payments to prevent against fraud.
Bulk commercial email, mailing lists and email reflectors are allowed on Aussie Tech Heads servers, we do however have a limit of emails per hour per account. For any emails sent from your Aussie Tech Heads account you must adhere to the following rules:
i. Your intended recipients have given their consent to receive e-mail via some affirmative means, such as an opt-in procedure;
ii. Your procedures for soliciting consent include reasonable means to ensure that the person giving consent is the owner of the e-mail address for which the consent is given;
iii. You may not obscure the source of your e-mail in any manner; and
iv. You otherwise comply with the CAN SPAM Act or other applicable international law, or laws in your region.
You must take reasonable security precautions. You must protect the confidentiality of your password, and you should change your password periodically. If any user data is collected, then you must take reasonable security precautions for your user data. We are not responsible for this security and you must take additional precautions.
Pineatix’s has some services where ‘Unlimited’ usage of resources are allowed including but not limited to bandwidth, diskspace, email accounts, sub-domains, FTP accounts and other account features. The disk space any other resources used as referenced previously, are to not be used excessively or inappropriately. This is decided at the sole and absolute discretion of Pineatix.
Essentially, any Sites of Services whose purpose is to use a lot of disk space or network bandwidth is not allowed. This list below includes but is not limited to things that are not allowed on our hosting plans:
i. File upload, sharing, archive, backup, mirroring or distribution services;
ii. A site created primarily to distribute large documents, images or videos;
iii. A site created primarily to drive traffic to other sites;
iv. Excessive websites that may overutilize bandwidth or resources (RAM, CPU, etc);
v. Spam cannons; shared hosting is not suitable for automated, mass emailing services;
vi. Distribution of content for which you don’t hold usage or distribution rights;
vii. Sites that continue to get hacked or suffer repeated security breaches;
viii. BitTorrent software;
ix. Proxy Software;
x. IRC Bots/Bouncers;
xi. Network Daemons;
xii. Abusive scripts, processes;
xiii. Adult Thumbnail Galleries / Banner Exchanges;
xiv. Spamming, Excessive Mass Mailouts; and/or
xv. Fraudulent activity of any kind.
Pineatix is under no duty and does not by this Policy, the Terms of Service Agreement nor any other policy undertake a duty, to monitor or police our customers’ activities and disclaims any responsibility for any misuse of the Pineatix network.
