Please read this Data Processing and Protection Policy (herein, "Privacy Policy") agreement carefully as it contains important information regarding your legal rights, remedies and other information regarding the business-consumer relationship between Pineatix and you.

Overview

This Privacy Policy addresses how Pineatix will collect, use and protect your information, your privacy rights and responsibilities of you, and Pineatix. This Privacy Policy is written in accordance to the Australian Privacy Act 1988, and the Australian Privacy Principles outlined in the act.

Personal data is generally classified as any information or opinion, whether true or not that is recorded in a material form or not, that could directly or indirectly identify you.


Scope

This Privacy Policy applies to the Customers of Pineatix, as well as any other person who accesses our Site or any Services as defined in the Terms of Service Agreement, which is hereby incorporated into this policy by reference.


What information do we collect?

Pineatix collects information so that we can provide our Services to you. When you initially sign up for a User Account on our Site, or purchase a Service, we collect some information essential to providing the Service including but not limited to;
A. Your full name, email address, physical address and phone number;
B. Your online IP Address;
C. Payment information such as your credit/debit card number, expiry date and CVV; and
D. Your Data, Your User Content and any other collected information as defined in the Terms of Service Agreement.


How do we utilise your information?

Pineatix uses your personal information to successfully provide high quality Services to our Users. We strongly believe in both minimalising the data we collect and limiting its use and purpose to only that for which we have been given permission for; and as necessary to deliver the services in which you purchase or interact with; or as might be required or permitted for legal compliance or other lawful purposes. These can include:
I. Delivering, improving, updating and enhancing the services we provide to you;
II. Diagnosing problems where appropriate;
III. Detecting and preventing fraud and abuse of our Services or payment systems; and
IV. Collecting aggregate statistics about use of the service and statistics related to event attendance.


Who can access your information?

Pineatix has extensive security measures in place in order to protect your information from unauthorised people accessing it. Your data can be accessed by any employee or person working at Pineatix. All identifiable data is not visible to any third-party person and will not be shared without your direct consent, with limited exemptions listed below. We will send you an email or call you asking for this. Your also acknowledge and agree that if you purchase a service from a third-party provider, you are willing to share information with the third party for them to provide their Services in accordance with their Privacy Policy. If declined, we will not share the information however some aspects of service may not be able to be supplied.
Exemption to the above:
The only exception to the above rules for access is when we need to comply with legal, regulatory and law enforcement requests:
We cooperate with the government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law officials or private parties as we, in our sole and absolute discretion, believe necessary or appropriate to respond to claims and legal processes (such as a subpoena), to protect our property and rights or the property and rights of a third party, to protect the safety of the public or any person, or to prevent or stop activity we consider to be illegal or unethical.
Third Parties:
Some information will be passed onto third parties for the successful provision of our service. This can include but is not limited to processing credit/debit card payments, serving advertisements, conducting contests or surveys, communicating with you by such ways of email or survey delivery, and performing analysis of our customer demographics.

We only share information as absolutely necessary. These third parties (and any subcontractors) are subject to the privacy obligations to your information and are also subject to additional strict data processing terms and conditions.
How you can access, update or delete your data:
You can contact Pineatix at any time for a complete report of data stored on Your Account. You may also request that the data is erased at any time by contacting us. It is important to note that electing to remove some data, you may be forfeiting some or all of your services where data is required.
How we store, secure and retain your data
Pineatix follows generally accepted standards to store and protect the personal data we collect, both during transmission and once received and storing, including utilisation of encryption where appropriate.

We retain your data only as long as necessary to provide the Services you have requested and thereafter a variety of legitimate legal or business purposes. These can include retention periods mandated by law, contract or similar; for preserving, resolving and defending or enforcing our legal rights; or needed to maintain adequate business and financial records.


Pseudonymity

You have a right to use a pseudonym when using our services, this is not allowed however when processing payments to prevent against fraud.
